Terms of Service

By proceeding with a rental from Toronto Jet Ski Rentals Inc, you agree to abide by all the terms and conditions outlined in this document. These terms are in place to ensure the safety of all participants, the proper use of our equipment, and a clear understanding of your responsibilities as a renter. We are committed to providing a fun and secure experience on Lake Ontario, and your adherence to these guidelines helps us maintain our high standards for service and safety. Please read all sections carefully before your rental.

WHAT’S INCLUDED WITH RENTAL?

Free Boating Licence (Temporary Operator’s Permit) will be issued to you or bring your own if you already have one.

IMPORTANT: You are required to check in 40 minutes before your ride time to complete the Operator’s Licence/Permit review, safety briefing, and operational instructions.

Upon parking at Humber Bay or Lakefront Promenade Boat Launch, please call us immediately at 416-660-1132 for directions to our exact location on the beach.
Do not text or try to locate us yourself, as this may delay your appointment.
During the busy summer season, late arrivals will only receive the remaining time on their reservation. This is a firm policy. Please arrive on time!

Cell Phone (Mandatory in case of emergency on the water)

AGE & ELIGIBILITY REQUIREMENTS:

Renter must be at least 20 years old and possess a valid Ontario Driver’s Licence: G2, G, M2, or Pleasure Craft Operator Card.
(Out-of-Province or International driver’s licences are also accepted.)
Any additional operator must also be at least 20 years old and be listed on the rental agreement.
Transport Canada requires all pleasure craft operators to carry a boating licence. A free temporary licence will be provided if needed.
Understanding English is mandatory. For safety reasons, jet skis cannot be rented to individuals who do not understand English, as all safety instructions are provided in English only.
 

ADDITIONAL CHARGES (IF APPLICABLE):

(A) Late Returns:
 
$39.99 every 15 minutes (per jet ski). This is a firm policy.
 
(B) Lost, Stolen, or Damaged Items:
 
PFD / Life Vest: $59.99 each
Safety Kit: $19.99 each
RF D.E.S.S. Key: $67.99 each
Recovery Service (GTA): $499.99 each
Rock Ingestion: $500–$2000 (based on damage)
Damaged Gauge Cluster: $1000
Rope Ingestion: $300–$1500
 
All additional charges are subject to 13% HST and will be deducted from your damage/security deposit.

 

DAMAGE / SECURITY DEPOSIT:

A $1,000 Damage/Security Deposit hold is required per jet ski. Payment methods accepted:

Deposit is paid in person on the rental day.
After a full damage inspection, the deposit will be returned in full if no damage is found.

Damage inspections will be performed by Toronto Jet Ski Rentals Inc. staff before and after the rental.
Renters are responsible for all damages to vessels, equipment, or persons during their rental period.
Signing a rental contract and waiver of liability is mandatory for all participants 18 years or older.
Damage deposits do not limit the renter’s liability in the case of severe or total loss.
 

 

CANCELLATION & REFUND POLICY:

Cancellations made more than 1 week in advance: 97% refund
Cancellations made more than 48 hours but less than 1 week in advance: 50% refund
Cancellations within 48 hours of rental: no refund
No-shows will be charged in full, and reservations will be cancelled after 1 hour
Toronto Jet Ski Rentals Inc. reserves the right to cancel, reschedule, or void any reservation at any time due to:
Policy violations
Severe weather
Safety concerns
Refunds eligible for full reimbursement will have 3% deducted automatically by the payment processor (Stripe Inc.). This is a firm policy.
eGift Card sales are final and non-refundable. Cards do not expire and cannot be redeemed for cash.

WEATHER POLICY:

Toronto Jet Ski Rentals Inc. reserves the right to:
 
Cancel rentals due to weather conditions including:
High winds
Lightning
Gusts over 15 kph (8 knots)
Wave heights above 2 metres
Light rain or overcast will not result in cancellation.
If you live within the GTA (Toronto, Peel, York, Durham, Halton), no refunds will be issued due to weather.
You have 1 year to reschedule your rental at no extra charge.

If you are outside the GTA, Out-of-Province, or International, and request a weather-related refund, a 30% operational fee will be deducted. This is a firm policy.

ADDITIONAL POLICIES:

Use of drugs and alcohol is strictly prohibited. Violators may be subject to Marine Police charges.
Only individuals listed on the rental agreement, who have either a boater’s licence or have completed the safety checklist, may operate the watercraft.
Toronto Jet Ski Rentals Inc. prohibits joint operation with any other rental company, private jet skis, boats, or yachts during your ride time.
Renters must obey all marine laws, including:
Speed limits
“No wake” zones
Reduced speeds near shorelines or canals
Responsible and attentive driving
Mandatory safety equipment is included and must remain on board unless used in an emergency.
• Life vests must be worn properly at all times.
Renters must carry a cell phone on the vessel for emergency purposes.

Waiver Agreement

JET-SKI RENTAL GENERAL RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS, AND INDEMNITY AGREEMENT

Toronto Jet Ski Rentals Inc. and its directors, officers, employees, instructors, guides, affiliates, representatives, independent contractors, subcontractors, suppliers, sponsors, successors, and assigns (all of whom are hereinafter referred to as “the Releasees”)
 

DESCRIPTION

In this agreement the term “Toronto Jet Ski Rentals Inc.” shall include all rental gear, equipment, and services wholly provided by Toronto Jet Ski Rentals Inc. Such sport rentals include, but are not limited to, kayaking, canoeing, snowshoeing, cross-country skiing, snowmobiling, mountain biking, ATVing, jet skiing, tobogganing, and including—but not limited to—orientation and instruction sessions, transportation or travel to and from the starting point, loading and unloading of vehicles, trailers, sports equipment, inflatable boats, camping gear, backpacking, fishing, hiking, backcountry travel, and all recreational activities offered (hereinafter referred to as “The Activities”).

ACKNOWLEDGEMENT

I acknowledge that I have been advised to wear appropriate safety and protection gear while using any of the sport rentals. Instruction in the proper use of the sport rental is available from the staff. I am aware that the physical exertion required to participate in “The Activities” and the forces exerted on the body can activate or aggravate pre-existing physical injuries, conditions, symptoms, or congenital defects. I have been advised to seek medical advice if I know or suspect that my physical condition may be incompatible with The Activities.


I will inspect the equipment to ensure that it is in good working order and I will accept it as is. I agree to assume all risks and responsibilities for any and all claims for damages and for injuries suffered while using the sport equipment rentals, and to hold Toronto Jet Ski Rentals Inc., its staff, and guides harmless and not responsible for injury or accident incurred while using the rented equipment. In addition, I acknowledge that I am not, nor will I be, under the influence of drugs, alcohol, or any other substance while participating in the activities.


I understand that I am responsible for returning the sport equipment and accessories upon return from “The Activities.” I also understand that there will be a late fee charge at the reserved item rate per day, per item until returned. Equipment not returned after fourteen (14) days will be deemed lost. Equipment must be returned in good working order and clean or a fee will be assessed for each item. Damaged or lost equipment will be assessed at the current retail price for repairs or replacement (retail and replacement costs are available upon request), unless Damage Insurance was purchased, in which case charges will only be incurred if items are lost. Charges made on lost or damaged equipment are not contestable. I agree that all late, lost, or damaged fees may be charged to my credit card.

ASSUMPTION OF RISKS

I assume full responsibility for any personal damages I incur and for the equipment rented from Toronto Jet Ski Rentals Inc. I assume that liability for all damages incurred through the use or misuse of the equipment listed in this agreement. I agree to pay for damages incurred to rented equipment in excess of normal use and depreciation, as assessed by Toronto Jet Ski Rentals Inc. staff.
I am also aware that there is a risk of NEGLIGENCE, BREACH OF CONTRACT, and BREACH OF STATUTORY DUTY ON THE PART OF THE OPERATORS, INCLUDING THE FAILURE BY THE OPERATORS AND THEIR STAFF TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS, AND HAZARDS OF THE ACTIVITIES. I FREELY ACCEPT AND FULLY ASSUME ALL RISKS, DANGERS, AND HAZARDS ASSOCIATED WITH THE ACTIVITIES AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE OR LOSS RESULTING THEREFROM.

GENERAL RELEASE OF LIABILITY AND WAIVER OF CLAIMS

In consideration of THE OPERATORS agreeing to my participation in “The Activities” and permitting my use of its equipment, vehicles, parking, and sport equipment rentals, and for other good and valuable consideration, the receipt and sufficiency of which is acknowledged, I hereby agree as follows:


TO WAIVE ANY AND ALL CLAIMS known or unknown that I have or may in the future have against THE OPERATORS AND THEIR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, GUIDES, INSTRUCTORS, INDEPENDENT CONTRACTORS, SUBCONTRACTORS, AND REPRESENTATIVES (all of whom are hereinafter referred to as the “RELEASEES”), AND TO RELEASE THE RELEASEES and its agents, successors, and assignees from any and all liability for any loss, damage, expense or injury including death that I may suffer, or that my next of kin may suffer, as a result of my participation in “The Activities,” DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE OCCUPIERS’ LIABILITY ACT, ON THE PART OF THE RELEASEES, AND FURTHER INCLUDING THE FAILURE ON THE PART OF THE RELEASEES TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS, AND HAZARDS OF “THE ACTIVITIES” AND “SPORT EQUIPMENT RENTALS.”

HOLD HARMLESS AND INDEMNITY AGREEMENT

To hold harmless and indemnify the Releasees from any and all liability for any property damage or personal injury to any third party resulting from my participation in “The Activities” and “Sport Equipment Rentals”;

That this Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns, and representatives, in the event of my death;

That this Agreement shall be governed by and interpreted in accordance with the laws of the Province of Ontario; and

That any litigation involving the parties to this Agreement shall be brought within the Province of Ontario.

I acknowledge and accept that the Marine Liability Act, S.C. 2001, c.6, may limit the liability of the Operators in the event of an accident resulting in injury or death.
In entering into this Agreement I am not relying on any oral or written representations or statements made by the Releasees with respect to “The Activities” other than what is set forth in this Agreement.
